DMVX is an independent product of Choto Agency, Inc. It is not affiliated with or endorsed by the NY DMV (New York State Department of Motor Vehicles) or the NYS Department of Taxation and Finance.

1. Agreement

These Terms govern your purchase and use of DMVX, a Windows desktop application sold by Choto Agency (“Choto Agency, Inc.”, “we”, “us”), and this website. By checking the box at purchase, buying a license, or using DMVX, you agree to these Terms on behalf of yourself and the office you represent. If you do not agree, do not buy or use DMVX.

2. License grant

Subject to these Terms and payment of the fee, Choto Agency, Inc. grants the purchasing office a limited, non-exclusive, non-transferable, non-sublicensable license to install and use DMVX at one office location for one year from the date the license code is issued (the “Term”).

  • One license covers one office. Additional offices need their own licenses.
  • You may not sell, rent, lease, share, or transfer the license or license code to anyone else.
  • You may not copy, reverse engineer, decompile, or remove license checks from DMVX, except where the law does not allow this restriction.
  • Choto Agency, Inc. keeps all ownership of DMVX and its content. No rights are granted except those stated here.

When the Term ends without renewal, DMVX opens in read-only (view-only) mode. You can still view your existing records but cannot create new work until you renew. The license check is a convenience measure and does not change these Terms.

3. Independent tool; your responsibility for accuracy

DMVX helps you prepare forms, including NY DMV and NY Department of Taxation and Finance forms. It is not legal, tax, or compliance advice, and it does not file anything for you.

  • You are solely responsible for the accuracy and completeness of every form you prepare, print, or file, and for all information you enter.
  • You must verify every form against the current official form and instructions before filing or giving it to a customer.
  • You are responsible for complying with all NY DMV, tax, and other laws, rules, and record-keeping requirements that apply to your business.
  • Forms, fees, and rules change. DMVX may be out of date at any time.

4. Acceptable use

You agree to use DMVX only for lawful business purposes. You will not use it to prepare false, fraudulent, or misleading documents; violate any law or the rights of others; bypass or tamper with licensing; or distribute the software or license codes to others. We may end your license if you breach this section.

5. Fees, payment, and renewal

The fee is $119.00 per year per office license, plus any applicable taxes. Payment is made by credit or debit card and processed by Square, Inc. We do not see or store your full card number. Licenses do not renew automatically unless we clearly tell you otherwise at checkout; to continue after the Term you buy a renewal and receive a new license code. We may change prices for future terms and will not change the price of a Term already paid.

6. Refunds

If DMVX is unusable on your computer and we cannot fix the problem, you may request a full refund within 14 days of purchase by emailing miltonchoto@gmail.com. Please describe the problem so we can try to help first. After 14 days, fees are non-refundable except where the law requires otherwise. Approved refunds go back to the original card through Square.

7. Updates and form packs

During your Term, we aim to provide updates, including updated form packs, when we make them available. We do not promise a particular schedule, that every form will be current, or that updates will be available for every form. Updates may need to be downloaded and installed by you.

8. Your data

DMVX runs on your computer and stores your data there. You own your data and are responsible for backing it up and protecting it. See our Privacy Policy.

9. Support

Support is provided by email at miltonchoto@gmail.com on a reasonable-efforts basis.

10. Disclaimer of warranties

DMVX IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CHOTO AGENCY, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DMVX WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY FORM IT PRODUCES IS CURRENT, COMPLETE, OR ACCEPTED BY ANY AGENCY.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHOTO AGENCY, INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, REJECTED FILINGS, PENALTIES, FINES, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO DMVX WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

12. Indemnity

You agree to defend and hold Choto Agency, Inc. harmless from claims, losses, and expenses arising from your use of DMVX, the forms you prepare or file, or your breach of these Terms.

13. Termination

You may stop using DMVX at any time. We may suspend or end your license if you materially breach these Terms, with a refund of the unused portion of the fee if the termination is not due to your breach. Sections that by their nature should survive (including 3, 10, 11, 12, and 14) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Nassau County, New York, and you consent to their jurisdiction. Please contact us first so we can try to resolve any issue informally.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows the latest version. Changes apply to purchases and renewals made after the update; continued use after a change means you accept it for future terms.

16. General

These Terms are the entire agreement between you and Choto Agency, Inc. about DMVX. If any part is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent.
